Understanding the T Visa—A Path to Safety and Legal Status for Survivors of Human Trafficking

Human trafficking is a heinous crime that affects countless individuals around the world, including here in the United States. For survivors, escaping the grip of traffickers is just the beginning of a long and challenging journey toward safety and recovery. Fortunately, the T visa offers a crucial pathway for survivors of human trafficking to obtain legal status in the U.S., providing protection and the opportunity to rebuild their lives.

What is a T Visa?

The T visa is a special immigration status designed for victims of severe forms of human trafficking, including both sex trafficking and labor trafficking. This visa allows survivors to remain in the United States for up to four years, during which they can work, access social services, and eventually apply for permanent residency (a green card). In addition, T visa holders can apply for certain family members to join them in the U.S., further supporting their journey to safety and stability.

To be eligible for a T visa, survivors must demonstrate that they have been a victim of trafficking, are physically present in the United States on account of the trafficking, and are complying with any reasonable requests for assistance in the investigation or prosecution of the trafficking, unless they are under 18 years old or unable to cooperate due to trauma. They must also show that they would suffer extreme hardship involving unusual and severe harm if removed from the United States.

The T Visa Application Process

Applying for a T visa involves submitting Form I-914, Application for T Nonimmigrant Status, along with evidence of the trafficking experience and cooperation with law enforcement. This evidence can include affidavits, police reports, medical records, and statements from service providers. Given the sensitive nature of these cases, it’s crucial to work with an experienced legal team that understands the complexities of the T visa process and can provide the necessary support and advocacy.
